Terms of Service

Last updated: February 2026

1. Scope

By installing or using EULabel ("the app"), you agree to these Terms of Service. If you do not agree, please do not use the app.

2. Description of Services

EULabel is a Shopify app for LMIV compliance (EU Food Information Regulation 1169/2011) for food retailers. The app offers:

3. Right of Use

You may use EULabel to:

4. Pricing and Billing

EULabel uses a subscription model with monthly scan quotas. All core features (product management, compliance checks, Nutri-Score, theme blocks) are free and available without product limits.

The following plans are available for automatic label scanning and translations:

All prices include VAT. Billing is monthly (every 30 days) via the Shopify billing system. Scan quotas reset at the beginning of each billing period. Unused scans do not carry over. The subscription is cancelable at any time.

5. Privacy and Data Processing

EULabel stores LMIV data directly in Shopify metafields in your shop. We do not store any product data on our servers.

When using the automatic label scan, the uploaded image is sent to the Google Gemini API for text extraction. The image is used exclusively for this one-time processing and is not stored permanently. The extracted data is saved as metafields in your Shopify shop. When using the automatic translation feature, your LMIV text data (ingredients, storage instructions, etc.) is sent to the Google Gemini API and the translations are saved as metafields. By using these features, you consent to this data transfer.

For further details, please refer to our privacy policy.

6. Disclaimer — No Warranty

EULabel is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

No legal advice: The app does not constitute legal advice and does not replace legal, food-law or professional consultation. Compliance scores, assessments and all other results are purely informational and do not guarantee compliance with the LMIV or any other regulations.

We specifically do not guarantee that:

Use at your own risk: Your use of EULabel is entirely at your own risk. Full responsibility for the accuracy, completeness and legal compliance of all food information lies exclusively with the food business operator (you) under EU Regulation 1169/2011 (LMIV).

Obligation to review: All automatically generated data (scan results, translations, compliance assessments, nutritional calculations) may contain errors and must be reviewed and, if necessary, corrected by you before publication. We strongly recommend having all information additionally reviewed by a qualified professional (e.g. food chemist, lawyer).

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages of any kind arising from or in connection with your use of EULabel, regardless of whether we have been advised of the possibility of such damages.

Explicitly excluded is in particular any liability for:

In any event, our liability is limited to the total amount you have paid for your subscription in the last 12 months, up to a maximum of €80.

8. AI Technology and Accuracy

EULabel uses AI technology (Google Gemini) for automatic label scanning and translations. This technology is subject to inherent limitations:

We accept no responsibility for decisions made on the basis of AI-generated results.

9. Availability and Data Integrity

We do not guarantee any specific availability, speed, or performance of the app. The app may be modified, interrupted, or discontinued at any time without prior notice.

Recommendation: Create regular backups of your product data. Do not rely on the app as your sole data source.

10. Indemnification

You agree to indemnify and hold harmless us, our employees, and contractors from any claims, costs (including legal fees), damages, and liabilities arising from or in connection with:

11. Changes to Terms

We may update these Terms of Service from time to time. In the event of material changes, we will notify you via the app. Continued use of the app after changes constitutes acceptance of the new terms.

12. Applicable Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany. Disputes shall be resolved exclusively before the competent German courts.

If the customer is a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the provider's place of business (Saarland, Germany).

13. Severability Clause

If any provision of these Terms of Service is or becomes invalid, the validity of the remaining provisions shall not be affected.
